To obtain work permits in Canada, employers must have a Labour Market Impact Assessment (LMIA). Also known as Labour Market Opinion (LMO), a Canadian employer can hire temporary workers from foreign nations.

LMIA application for employers, LMIA can be defined as a legal process where Employment and Social Development Canada (ESDC) evaluates an employment application to ensure that Canada’s foreign workers will not affect the Canadian workers. An applicant, or an employer, needs to provide detailed information about the job they want to offer to a foreign national. The applicant must show how many Canadians applied for the job, who got interviewed, and why they didn’t hire the candidate.

There are multiple things that ESDC considers while evaluating the application.

  • The work environment that the foreign national will be provided matches the country’s current work standard and labour laws.
  • The salary offered to the foreign national is consistent with the average for the job in the area.
  • How will the foreign worker affect the work conditions in the country?
  • How will the foreign worker affect jobs in the area?

LMIA Based Work Permits

To get a Canadian work permit, applicants have to pass a two-step process. First, the applicant needs to apply to ESDC for a Labour Market Impact Assessment. After that, another application is submitted to Citizenship and Immigration Canada (CIC) for the actual work permit.

Requirements to Apply For LMIA

  • Regulations passed in 2014, applicants or Canadian employers who want to hire foreign nations to deposit $1,000 as a processing fee for each application. Apart from that, they also need to pay a privilege fee of $100.
  • LMIA application for employers’ states that English and French will be the only languages for job requirements for LMIAs and job vacancy advertisements.
  • Canadian employers must post the job as an advertisement in the country’s job market for at least four weeks. After that, they can apply for LMIA.
  • Applicants must prove their awareness about the prohibition of laying off or cutting Canadian workers’ hours when hiring workers.

How Long Does It Take To Get LMIA

As per ESDC rules, it should take around ten business days for specific LMIA applications. This rule applies to jobs that are in high demand.
